A surgical error meant our client suffered a serious nerve injury during what should have been a routine procedure to remove a lump from the neck.

During the operation, carried out under local anaesthetic, a key nerve in the neck was inadvertently damaged. This caused immediate pain radiating into the head and neck, followed by ongoing weakness and muscle wasting in the shoulder area.

Despite undergoing further surgery in an attempt to repair the damage, our client has unfortunately not experienced any meaningful recovery. Medical experts have confirmed that the injury and resulting disability are permanent.

As a result, our client now lives with chronic pain, reduced movement in the shoulder, and a significant loss of strength. Everyday tasks, such as household chores and personal care, have become more difficult, and he now requires support from his partner for certain activities.

The Life-Changing Impact Of A Surgical Error

Before the injury, our client worked full-time in a physically demanding role and led an active lifestyle, including hobbies such as golf, gardening and weight training. He is now limited to lighter duties at work and is unable to carry out tasks involving heavy lifting or overhead movement. He has also had to give up many of the activities he previously enjoyed.

Medical evidence confirms that he will continue to experience symptoms long term and will require ongoing treatment, including physiotherapy and pain management, to help manage his condition.

Following negotiations, we secured a five-figure settlement for our client to reflect the impact the injury has had on his life.

The figure we were able to successfully claim for him was significantly higher than the original settlement offer proposed and while it doesn’t make the challenges faced any easier to navigate, it does mean our client has greater opportunity to move forward and create a new normal.
