What is Legal Aid?
If you are facing a criminal charge and you need urgent legal assistance but can’t afford the fees, you may be eligible for Legal Aid. Legal Aid is a government funded scheme which provides financial support to those whose income cannot stretch to cover legal fees. This allows for a fair justice system, with all members of the public able to have access to legal advice and representation when they need it the most.

Am I eligible for Legal Aid?
In order to apply for Legal Aid, you will have to undergo a means test as evidence that you do not have the funds yourself. There are certain requirements your case must have in order to be eligible for Legal Aid, so upon arrest, speak to one of our solicitors early on to check whether you can apply. As your solicitor, we are able to apply on your behalf. You can also check your eligibility on the Government website.
What happens in court?
For most motoring offences, drug offences, drunk and disorderly or burglary charges, your case will be heard in the Magistrates’ Court. The Crown Court is reserved strictly for more serious cases such as murder. Before your trial, the judge dedicated to your case will review all the evidence, familiarising themselves with the ins and outs of the accusation as well as analysing the witness statements. When the trial begins, you’ll have the opportunity to have your case heard in full after the jury has heard from the prosecution. That’s where having strong representation from experts in criminal law can benefit you greatly. Your defence will be heard by the judge as well as the jury, who will both make notes throughout. It’s then up to the jury to come to a decision through deliberation. Whatever the outcome, our solicitors will provide on-going support to ensure your human rights are protected at all times.
