Mediation

The first step is talking. Often, a calm negotiation can be more powerful than a courtroom confrontation. Our divorce solicitors are fully trained in mediation, allowing you and your ex-partner to express yourselves honestly without losing sight of the end goal. All too often, separating couples are quick to point the finger, and this is what makes divorce drag. The final destination of mediation is agreement, and we’ll be here to guide you through and ensure you stay on track until you reach it. What are the grounds for divorce?

No fault divorce came into force on 6 April 2022.  From this date the no fault based process applies to all divorce applications in England and Wales.

After 12 months of marriage you, your spouse or you both jointly can make an application for divorce on the grounds that your marriage has broken down irretrievably.  You are no longer required by law to apportion blame or to have lived apart for some time.

How long will the divorce process take?

The new divorce process can take a minimum of 26 weeks.  This does not factor in time needed for administration, processing and negotiations.  There are associated issues to resolve following separation such as financial matters and arrangements for children which will mean the entire process could take slightly longer.  Similarly, if both parties do not reach an agreement through negotiations or during mediation and additional Court proceedings are necessary, the process will take a lot longer. Essentially, the sooner you and your ex-partner can agree on important matters, the less time involved overall.
