How Does Talbots Collect Work?

Talbots Collect is designed to make debt recovery straightforward, with a clear process from the first letter through to further legal action if needed.

1. Tell us about the debt

You provide us with the details of the debt and any relevant information or documentation. We’ll review the circumstances and explain the next steps.

2. We send a fixed-fee Stage 1 Letter

We’ll contact the debtor on your behalf with a formal letter requesting payment. Our Stage 1 Letter is offered at a fixed fee of no more than £100 + VAT, so you know what the initial step will cost before we start.

3. The debtor pays

If the debtor pays following our letter, we’ll help bring the matter to a close. Our Success Credit model means that successful recoveries can help offset the cost of ineffective letters within the same two-week period. There’s no limit to the Success Credit available, meaning you could pay £0 for Stage 1 Letters depending on your recovery rate.
 

4. Further action if necessary

If the debtor still doesn’t pay, we can advise you on the next steps, including negotiation and settlement where possible, and, if necessary, legal proceedings or insolvency action to enforce payment.

What if my debtor refuses to pay?

How does the fixed-fee structure work?

You pay a fixed fee based on the stage of recovery and the number of instructions you provide in a two-week period. Fees are lower the more instructions you send, and our ‘Success Credit’ system helps offset the cost of unsuccessful recoveries. What is ‘Volume Discount’?

We want to work with you and support your business for the long-term, which is why we reward client loyalty by reducing our fixed-fee charges depending on the number of instructions you send us in a two-week period. We call this our Volume Discount. Find out more.

What is 'Success Credit'?

Success Credit is made up of a proportion of all legal costs and late payment compensation recovered under any Successful Letters sent during a two-week period.

More Successful Letters = More Success Credit.

We apply the Success Credit against the cost of any Ineffective Letters sent during the same two-week period. This reduces the overall sum payable by you.

There is no limit to the amount of Success Credit that can be applied, so depending on the number of successful recoveries made, it could mean that you pay nothing at all for the Stage 1 Letters we send. Find out more.

What is the debt recovery procedure?

The debt recovery procedure usually begins with a formal letter of claim to the debtor. This is followed by negotiation and settlement where possible, and, if necessary, legal proceedings or insolvency action to enforce payment.

At Talbots Law, our process is straightforward. We begin by reviewing your T&Cs and copy invoices to confirm the identity and address of the debtor and advise you on any additional interest or legal costs you are able to recover from them.

It’s a good idea to have evidence of their original agreement of payment – this could be a signed contract, or even a purchase order. If you can also provide evidence of the terms and conditions that they agreed to before entering into the agreement, even better. We also recommend that you find proof of the completed service or product that they received.

Next, we write a formal letter to the debtor requesting payment by a certain date, stating that if the payment is not made by this date, you will take legal action. We’ll take care of the letter, sending it directly from Talbots Law to reinforce the urgency to your customer.

If we can assist in recovering debt from your customer outside of court, we will. Our team of debt recovery lawyers have a diplomatic but direct approach, allowing you and your customer to discuss the situation openly while encouraging the debtor to make the payment. We try to keep things simple – after all, we know you don’t want to be involved in a long-running legal battle.
