Disputes over family inheritance are on the rise, with applications to challenge wills reaching record levels in the final quarter of 2024.
New data shows that 3,061 applications were lodged to enter a ‘caveat’ with the Probate Registry during Q4 2024 — the first time applications have exceeded 3,000 in a single quarter.
At Talbots Law, we understand why tensions around inheritance are growing. Experts link the rise to societal and demographic factors, including longer life expectancy and increasing reliance on inheritance amid a rising cost of living.
Why Inheritance Disputes Are Growing
Over the past five years, applications to the court to block probates have increased by 56%. This reflects research showing that nearly four in ten adults in the UK would consider disputing a will if they felt the inheritance was unfair.
The Generational Wealth Gap
A major factor behind disputes is the wealth gap between generations. Older generations hold a large portion of wealth in property and pensions, while younger generations face higher barriers to homeownership.
- The average UK property price reached £269,000 in May 2024, a 3.9% increase year-on-year.
- The number of homes priced at £1 million or more has doubled since the pandemic.
- The “Bank of Mum and Dad” is increasingly helping Millennials and older Gen-Z buyers onto the property ladder.
DIY Wills: A Risky Shortcut
Another reason inheritance disputes are rising is the growing use of DIY wills. Online will kits and non-professional services are appealing but often fail to address complex family or financial situations.
Research shows that over 20% of people with a will have used a DIY method instead of seeking professional advice.
Poorly drafted wills by unregulated providers can cause disputes. Mistakes are often not covered by professional indemnity insurance, leaving families with little recourse.
