A successful claim for our Contentious Trusts and Probate team, who have recently helped a client relating to trusts of land following a relationship breakdown.
Following the breakdown of a relationship, our client wished to establish their beneficial interest in a property purchased during the course of a relationship. The Defendant to the claim remained in occupation of the property after the relationship had ended and our client had moved out of the property.
We issued a claim on behalf of our client pursuant to the Trusts of Land and Appointment of Trustees Act 1996.
Not only were we able to successfully obtain an order that the property should be sold, we successfully obtained an order that provided that the Defendant must pay suitable rent to our client for the time they lived alone in the property.
Finally, our team successfully obtained an order that the Defendant pay our client’s legal costs. A successful claim all around!
