Defamation has been a household subject in recent times in view of the Johnny Depp v Amber Heard case and the Wagatha Christie Vardy v Rooney case owing to the recent celebrity revelations. However, defamation doesn’t only affect the rich and famous
A person or company’s reputation can often take years to build but only minutes to destroy. This has been exacerbated by the speed of online publications and social media alongside traditional social media outlets. However, quick action can prevent and limit damage to an individual or company’s reputation. This could include seeking an undertaking requesting that the defamatory statements are retracted and not repeated or injunctive relief to include a claim for damages for loss arising out of the defamatory comments.
A claim in defamation can be oral (known as slander) or written (known as libel). Time is of the essence with defamation, not only to prevent damage to reputation but also the law says that a claim for defamation must be brought within 12 months of the defamation.
There are various defences to a defamation claim which are contained within the Defamation Act 2013.
