Frequently Asked Questions

Why should I plan for my future?

Planning for the future can give you greater control over what happens to your finances, property and personal affairs, both during your lifetime and after your death.

Putting the right legal arrangements in place can also make things easier for the people you care about, helping them understand your wishes and deal with your affairs if you’re no longer able to do so yourself.

What should I consider when planning for my future?

There are several areas you may want to consider, depending on your circumstances. This could include making a Will, putting Powers of Attorney in place, considering inheritance and lifetime planning, making arrangements for your business or thinking about what would happen if you lost the capacity to manage your own affairs.

Our specialist Wills & Probate team can help you understand which areas of planning may be relevant to you and your family.

Do I need a Will?

Dying intestate (without a will) results in the law deciding who will inherit your estate and look after your children, and will also mean that any charities and friends may be prevented from benefitting.

Where there’s a DIY will, it could be a false economy – it may not meet legal requirements in order to be valid. It may use language that is confusing or ambiguous. Worse still, the will might not reflect your wishes, potentially leading to family disputes and inadequate provision for a loved one.

What is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint someone you trust to make decisions on your behalf if you are unable to do so yourself.

There are different types of LPA covering financial decisions and health and welfare decisions. Putting an LPA in place while you have the mental capacity to do so means you can choose who you would want to act for you.

What happens if I lose mental capacity without a Power of Attorney?

If you lose mental capacity without having made an appropriate Lasting Power of Attorney, someone you trust cannot simply take over your financial affairs on your behalf.

In some circumstances, an application to the Court of Protection may be necessary to appoint a deputy. This can be a more lengthy and involved process, which is why putting appropriate arrangements in place in advance can be valuable.

How can I plan for inheritance and inheritance tax?

Inheritance and lifetime planning involves considering how your assets may be passed on and whether there are steps you can take during your lifetime to achieve your wishes.

The right approach will depend on your circumstances, the assets you own and who you want to benefit. Our specialist team can advise you on the legal options available and how these fit alongside your wider estate planning.

When should I start planning for my future?

There’s no particular age or stage of life when you need to start planning. Your circumstances can change at any time, and major life events such as buying a property, having children, getting married, receiving an inheritance or starting a business may all be good reasons to review your arrangements.

Planning ahead means you have more opportunity to make decisions while you’re able to do so, rather than leaving important decisions to others later.
