Janet Moreton


Janet is a Director in the Dispute Resolution department and has extensive experience in a wide variety of contentious probate matters. Janet acts for beneficiaries, executors, and trustees, as well as both claimants and defendants in court proceedings relating to disputed wills, probate, or trusts and also deals with specialist Court of Protection work.

She is able to draw on her vast experience and expertise in both civil dispute resolution cases and disputed inheritance claims to provide a specialist service to clients. Janet is a firm believer in “jaw-jaw” not “war-war”, encouraging mediation and cost-effective settlements out of court, whenever possible.

Janet provides practical advice and assistance in all areas of will disputes, including: Inheritance Act claims, disputed promises, mistakes in wills, removal or substitution of personal representatives, challenges to the validity of a will including on the grounds of lack of capacity and undue influence, disputes relating to Powers of Attorney and Court of Protection proceedings, and executors’ and trustees’ duties and disputes.

Some of Janet’s recent work includes:

  • Representing her clients in a contested Court of Protection application for a statutory will. The matter was further complicated by a declaration as to property ownership which was required to be settled as a preliminary issue.
  • Successfully obtaining a section 50 order removing the executor of an estate who failed to properly complete the administration.
  • Achieving a positive result for her client in a case where the validity of the will was disputed on the grounds of capacity.
  • Quickly breaking the deadlock in a disputed trust matter which had been ongoing for a number of years, and achieving a resolution within three weeks of her instruction.
