What is a Power of Attorney document?

A Power of Attorney grants someone you trust with the authority to handle your affairs if, for whatever reason, you are incapable of doing so. It could come into effect immediately, or at a later date if things take a turn for the worst. You can appoint more than one person to act on your behalf, but you should also specify whether they should act independently or together. The person, or people you appoint must be over the age of 18 and put your best interests first at all times.

When it comes to creating your Power of Attorney documents, there are two types:

Lasting Power of Attorney

This legal document allows you to give authority to someone you trust to make decisions regarding your affairs on your behalf. When our solicitors draft one under your instruction, you will have the choice between:

  • A Lasting Power of Attorney (LPA) for Property and Financial Affairs
    This LPA grants authority to your chosen representative to handle all property and financial matters; from selling your house to dealing with any payments you have to make.
  • A Lasting Power of Attorney (LPA) for Health and Welfare
    This will allow the Attorney (the person you grant power to) to make decisions on matters such as your healthcare, where you live and how you are cared for.

General Power of Attorney

A General Power of Attorney can be revoked at any time. You might create one if you’ll be out of the country for a long period of time and need your spouse to handle a property transaction on your behalf, or deal with your financial affairs.
