Being a landlord comes with many responsibilities, and it’s only natural that somewhere down the line, a problem will occur. Last year, research from Shelter showed that over 213,000 people faced the threat of eviction after reporting a property issue to their landlord. Many more were too scared to talk to their landlord in the first place.

What are my rights as a tenant?

As an assured tenant, you cannot be legally evicted from the property you are renting unless your landlord has valid reason to do so. Breaking any terms laid out in the initial agreement, for example, failing to pay rent or doing damage to the property are grounds upon which your landlord can evict you.

Your rights as a tenant also include:

  • The right to have the property kept in a reasonable state of repair.
  • The right to not be treated unfairly or discriminated against for your age, race, gender, sexual preference or disability.
  • The right for your partner (if married or in a civil partnership) to take over the tenancy should you pass away before the end of the contract.

As the age old saying goes, rights come with responsibilities. As a tenant, you are responsible for paying rent on time (as well as any other payments agreed e.g council tax), taking good care of the property, complying with the rules a landlord has laid out such as a ‘no pets’ rule and finally, only sub-letting the property if your landlord allows it.

What are my rights as a landlord?

As a landlord, you have the following rights:

  • The right to increase rent. This depends on whether the tenancy is on a fixed term or periodic basis. If you wish to increase rent, your original tenancy agreement should cover a rent review policy. You must also give notice to your tenant before doing so.
  • The right to reasonable access to your property. However, your tenant has the right to “quiet enjoyment” of the property, which means it’s vital you provide your tenant with 24 hours notice before you visit.
  • The right to knowing who is living in the property on a day-to-day basis.
  • The right to terminate a tenancy without reason only if the fixed term has expired.
  • The right to be paid rent on time.

As a landlord, it is your duty to make repairs to the property upon request and ensure the living conditions are suitable, and do not pose a threat to the health or safety of your tenant.
