What is the commercial conveyancing process?
When a commercial property takes your interest, speak to a specialist in commercial conveyancing. If you’re happy to proceed, we’ll investigate the title to the property and commission any pre-contract searches.
Once we are satisfied with the outcome of the searches and enquiries raised, we’ll approve the draft-contract sent by the seller’s solicitor and raise any additional enquiries. Then, we’ll prepare the Transfer Deed for the seller’s approval. After you have provided the balance of purchase monies required, we can begin completion. As your solicitor, it’s our duty to ensure your Stamp Duty is paid and the transaction is registered with the Land Registry.
If you’re selling your commercial property, it’s also essential to seek sound legal advice and assistance for the process. After investigating your legal title to the property, our solicitors will prepare the Contract of Sale to send to the buyer’s solicitor. We’ll ask you to fill in a CPSE Enquiry form containing details about all aspects of the property for the buyer and their solicitor to approve. Once they approve, we’ll help you exchange contracts with the buyer, and they will pay the amount agreed for the deposit. Then, when we receive the Transfer Deed from the buyer, we’ll assist you in discharging any mortgage attached to the property in preparation for completion. In order for completion to happen, the buyer will forward the full balance agreed to you, and the transaction will be made legally binding.
