What should I look for in a commercial lease?

When entering into a commercial lease, there are many considerations to make before signing an agreement. We’ll help you to thoroughly ensure that all the issues below have been addressed before you sign, and help you understand your position before you enter into negotiations.

Title

Our commercial lease solicitors will investigate the landlord’s legal title to the property to make sure they can legally grant a lease. Where the landlord has a mortgage, the mortgage lender too will need to provide consent before the lease can be granted.

Amount payable

Before you sign the lease, you’ll undoubtedly want to consider how much rent will be payable over the period of time you are letting, so if you wish to negotiate this with the landlord, it’s best to do so as early as possible. As a tenant, you might be responsible for paying a service charge for the property or building insurance. These are aspects you will want to negotiate with the seller before signing, as you may secure yourself a better deal.

Value added tax

For commercial properties that are less than 3 years old, VAT will be chargeable to the tenant. This is just another consideration when planning your finances while letting the property.
