Revised How To Rent Guide

Attention all Landlords!

The Government has published a revised version of “How To Rent – A guide for current and prospective tenants in the private rented sector in England”.  This guide booklet sets out the consequences of entering into an assured shorthold tenancy (AST) and alerts tenants to the various legal requirements that exist in this sector.

New rules now apply for a landlord seeking possession of a property where the tenancy started on or after 1st October 2015, before a Section 21 Notice is regarded as valid.  And from 1st October 2018 it won’t matter when the tenancy started, these rules will apply to all ASTs.   Landlords’ statutory obligations include:

  • providing a tenant with a copy of the current version of “How To Rent” guide (either as a hard copy or, if the tenant agrees, via email)
  • Making sure that the tenancy deposit is protected in a Tenancy Deposit Scheme within 30 days of receipt and providing full details of the scheme to the tenant
  • Providing the tenant with a current gas safety certificate before the tenant moves in
  • Providing the tenant with a copy of the current Energy Performance Certificate
